Terms of Service

1. Acceptance and Eligibility

The individual operator identified at the top of this page operates Tracy Draw ("Tracy Draw," "we," "us," or "our"). The Service is available through draw.leolovetracy.com.

By creating an account, purchasing a credit plan, or using the Service, you confirm that you are at least 18 years old, have read and agree to these Terms and the Privacy Policy, and are authorized to agree for yourself or the organization you represent. If you do not agree, do not use the Service.

2. The Service

Tracy Draw is an online AI visual creation service that includes prompt- and reference-guided image generation, avatar generation, a Toastmasters poster maker, generated asset management, and an image generation API. Digital credits or time-limited access are made available as displayed at purchase or grant.

The Service relies on third-party AI models and infrastructure. Model capabilities, generation times, and availability may be affected by those providers. We do not guarantee any particular output, style, or uninterrupted availability.

3. Accounts and Security

You must provide accurate and complete information, protect your login credentials and API keys, and accept responsibility for activity under your account. You may not share, resell, or permit unauthorized third-party use of an account or API key.

Contact support immediately if you discover unauthorized use of your account, email, or API key. If you use the Service for an organization, you represent that you have authority to bind it.

4. Credits and One-Time Plans

Tracy Draw uses credits. Current offerings include trial plans and 30-day creation packs, and standalone credit packs may be offered later. Every purchase is a separate one-time transaction. It is not a subscription and does not automatically renew or charge you again.

The price, currency, credit amount, estimated output, and validity period are the values displayed when a plan is purchased or granted. Generation tasks consume credits at the price displayed or otherwise applicable when submitted. Plans do not change output quality or feature access unless the purchase page expressly says otherwise.

5. Payment and Payment Processors

Completing a purchase authorizes one charge for the amount and currency displayed at checkout. Unless stated otherwise, applicable taxes may be calculated at checkout.

Orders in mainland China are generally processed through XorPay with WeChat Pay. Orders in other routed markets are generally processed through Waffo Pancake hosted checkout using cards, Apple Pay, or Google Pay. Full card details are handled by Waffo Pancake and do not pass through or remain on Tracy Draw servers. WeChat Pay and wallet data are handled by the applicable payment channels under their own terms.

6. Credit Validity and Failed Tasks

Credits from different sources may have different validity periods. The applicable period is shown when the credits are purchased or granted. Expired credits cannot be used and are not redeemable for cash or transferable unless mandatory law requires otherwise.

If a generation fails before completion and the system records it as failed, Tracy Draw returns the credits actually deducted for that task under the existing workflow. A task credit return is separate from a refund of a plan purchase.

7. Purchase Refund Policy

You may request a full refund within seven days after purchase if all credits or benefits granted by that purchase remain unused. Used purchases and requests made after seven days are generally non-refundable, except for duplicate charges, verified billing errors, and rights required by applicable law.

Duplicate charges caused by a billing error will be refunded in full. Nothing in these Terms limits any mandatory cancellation, refund, or consumer right that applies where you live.

Send refund requests from the email associated with your account to support@draw.leolovetracy.com and include the account email, transaction ID, transaction time, and reason. We acknowledge requests within two business days and make a decision within five business days. Approved refunds are generally returned through the original payment method; settlement time depends on the payment provider.

• The voluntary refund assurance does not apply to an account suspended or terminated for a Terms violation, fraud, abusive chargebacks, or unlawful use.
• A refund revokes unused credits or benefits related to that order. If those credits have already been consumed, account use may be restricted until any resulting deficit is resolved.

8. Billing Disputes

If you believe a charge is incorrect, contact support@draw.leolovetracy.com first with verifiable transaction details so we can investigate. We acknowledge the request within two business days and make a decision on verified billing issues within five business days. This does not restrict your right to contact a payment provider or competent authority as permitted by law.

9. Inputs, Outputs, and Intellectual Property

You retain your rights in prompts, images, text, voice, and other content you submit. You grant Tracy Draw a limited, non-exclusive license only as needed to provide, secure, and troubleshoot the Service you request.

Subject to these Terms and your lawful rights in the input materials, you own the output generated at your request and may use it for lawful personal or commercial purposes. AI outputs may resemble other outputs or contain material subject to third-party rights. You are responsible for review and necessary permissions before publication, commercial use, or use in sensitive contexts.

Tracy Draw itself does not use your inputs or outputs to train AI models. Data needed to complete a request may be sent to third-party AI providers and remains subject to their terms and data practices.

10. Acceptable Use Policy (AUP): Content Standards and Prohibited Categories

You may use the Service only for lawful purposes and are responsible for your inputs, outputs, and subsequent use.

The following six content categories are expressly prohibited from being generated, uploaded, distributed, or facilitated through the Service. These standards apply to prompts, reference materials, generated results, API requests, and subsequent use of generated content.

• Pornographic / NSFW content: pornography, explicit sexual acts, nudity intended for sexual arousal, and non-consensual sexual content are prohibited.
• Violent / graphic or gory content: realistic depictions of serious injury, dismemberment, torture, death, or gore, and content that glorifies, encourages, or instructs real-world violence are prohibited.
• Hate speech: content that attacks, demeans, dehumanizes, discriminates against, or incites violence against people based on race, ethnicity, nationality, religion, sex, sexual orientation, gender identity, disability, or another protected characteristic is prohibited.
• Child-unsafe content, including child sexual abuse material (CSAM): any sexualization, sexual exploitation, grooming, or abuse of a minor is strictly prohibited, whether the person, image, or scenario is real, fictional, or AI-generated.
• Deepfakes / impersonation: deceptive, fraudulent, harassing, or non-consensual use of a real person's name, likeness, voice, or identity, including non-consensual sexual deepfakes, is prohibited.
• Copyright / trademark infringement: protected works, characters, brands, logos, or trademarks may not be used without authorization or another valid legal basis to create infringing, counterfeit, or source-confusing content.
• Do not create other illegal, defamatory, harassing, fraudulent, terrorist, or extremist content, or provide operational guidance for weapons, mass violence, malware, phishing, scams, cyberattacks, or evading security controls.
• Do not bypass usage, billing, access, or security controls; disrupt the Service; create accounts in bulk; or resell the Service without permission.
• Do not systematically scrape outputs or use Service inputs, outputs, model responses, or derived data to train, fine-tune, distill, benchmark, or develop an AI model that directly or indirectly competes with Tracy Draw.
• Do not present AI output as advice from a doctor, lawyer, financial adviser, or other professional where reliance could cause harm.

11. User Reporting, Content Moderation, and Enforcement

Report content or conduct that violates these standards by emailing support@draw.leolovetracy.com with the subject "Content Report." Include, where available, the relevant page or content link, task ID, account information, violation category, and necessary evidence. Do not submit sensitive personal information unrelated to the investigation.

We keep a reporter's identity confidential where practicable and permitted by law, and review reports impartially. Malicious, repetitive, or knowingly false reports may be recorded and may result in restrictions on the reporting channel or account.

Tracy Draw uses a content-moderation process combining AI-provider safety filtering and human review. Every generation request is subject to the selected AI provider's safety rules; the provider may evaluate prompts, reference materials, and generated outputs during processing. Tracy Draw processes and records moderation or guardrail results returned by providers. A request that triggers a safety rule may be refused, stopped, or handled only in a safer form that does not preserve the prohibited intent.

We may manually review relevant inputs, outputs, task records, and account activity when necessary to investigate a user report, repeated safety blocks, or another high-risk signal. We do not proactively conduct human review of every item of private content, and automated detection cannot identify every violation, so user reporting remains an important part of moderation.

Confirmed violations may, depending on severity, result in refusal or termination of generation, removal of or restricted access to related content, a written warning, feature or API restrictions, account suspension or termination, preservation of necessary evidence, and reports to competent authorities or law enforcement when required or permitted by law. Reports involving CSAM, a credible threat of imminent physical harm, or terrorism are prioritized.

Reports are generally acknowledged within two business days and receive a decision within five business days. Complex investigations may take longer; where practicable, we will explain the reason and expected timing.

12. Privacy and Data

We process personal information as described in the Privacy Policy at draw.leolovetracy.com/privacy. You must have a lawful basis and necessary permissions for personal information or third-party materials you submit to the Service.

13. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without express or implied warranties of merchantability, fitness for a particular purpose, non-infringement, continuous availability, or AI output accuracy. AI output can be inaccurate, incomplete, or unsuitable and is not legal, medical, financial, or other professional advice.

To the fullest extent permitted by law, Tracy Draw is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our aggregate liability for claims relating to the Service will not exceed the amount you actually paid Tracy Draw during the 12 months before the event giving rise to the claim. This limitation does not exclude liability that cannot legally be limited.

14. Suspension, Termination, and Account Closure

We may restrict, suspend, or terminate access if an account violates these Terms, is involved in suspected fraud or unlawful activity, threatens Service security, or must be acted on by law. If we permanently discontinue a paid Service for reasons unrelated to your breach, we will provide a reasonable remedy for unused purchased benefits as required by applicable law.

You may request account closure through the support email at any time. Access and unused benefits end when the account is closed. Personal information is retained and deleted as described in the Privacy Policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the People's Republic of China. The parties will first attempt in good faith to resolve a dispute through support@draw.leolovetracy.com. Unresolved disputes will be submitted to a court with jurisdiction where the operator is located.

This choice does not affect mandatory consumer protections that cannot be excluded under the law where you live, or your right to complain to or seek relief from a competent authority.

16. Changes and General Terms

We may update these Terms. Material changes will generally be announced on the website or sent to the registered email at least 15 days before they take effect, and the date on this page will be updated. Urgent changes required by law, security, or abuse prevention may take effect immediately.

If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a right is not a waiver. These Terms and the Privacy Policy form the entire agreement for the Service. If the Chinese and English versions conflict, the English version controls unless mandatory law requires otherwise.

This monitored inbox generally acknowledges requests within two business days and provides a decision within five business days.
